‘Take down’ policy
If a complaint is received, the coordinators of ViPs will investigate the matter and consider removing any material from the ViPs website.
Complaints include contact from:
- the owner or representative of the owner with Intellectual Property Rights in all or part of the resource
- the creator of all or part of the resource who has moral rights
- any individual or organisation who believes that any of the material held on the ViPs is in some way illegal.
Complaints will include notice of:
- unauthorised use by reason of reproduction and/or making available the protected material
- breach of the moral right (paternity/integrity/right not to have work subjected to derogatory treatment)
- issues on grounds other than copyright and/or related rights (e.g. defamation, breach of confidence, data protection).
‘Take down’ procedure
On the page of the website which presents the IPR and takedown policy, a comments form will be available for the complainant (see below), which asks them to specify the resource and the grounds for the complaint. This comment form will be set up to be sent via email to a responsible member of the coordinating group of ViPs or to a general ViPs email monitored by the coordinating group on a regular basis.
Following an initial assessment, if the complaint is found to be valid and needing to be pursued, content will be temporarily removed pending an agreed solution.
For CONTRIBUTIONS (materials hosted by ViPs), ViPs will contact the contributor of the material and inform them that the item is subject to complaint and under what allegations. ViPs will seek advice on Intellectual Property Management and if required other professional opinion. All attempts will be made to resolve the issue to the satisfaction of both the complainant and the contributor.
Resolution will lead to one of the following outcomes:
- The resource need not be changed and will continue to be made available
- The resource is replaced with changes
- The resource is permanently removed.
For LINKS (links to external materials not hosted by ViPs), the link will be removed pending investigation and seeking of advice, including from the original creator if appropriate. Resolution will lead to one of the following outcomes:
- The link need not be changed and can continue to be made available
- The resource is permanently removed.
